

Creation of Rules by Cases: From the Perspective of Judicial Review Standard in China
Chinese courts continue to create rules in the field of judicial review standards, the so-called "court-made law", the rule of which is to resort to collectivism in the creation of rules, with judicial interpretations as the main carrier in the early stage, and Guiding Cases supplemented by Gazette cases in the later stage, and gradually forming a three-dimensional standard system of "legality standard", "reasonableness standard" and "procedural fairness standard".
This book fills in the research on the creation of standard rules for judicial review of Chinese courts, and summarizes the local characteristics of the creation of standard rules for judicial review of Chinese courts through comparative research, which is helpful to promote the comprehensive development of China's precedent system.
